The information provided to you by the American Chiropractic Association (ACA) on its website www.acatoday.org and any other affiliated websites (known hereinafter as “Website”) are subject to the following terms of use (known hereinafter as “TOU”). Your use of the Website affirms your acceptance of the TOU and all stated rules and policies. ACA reserves the right in its discretion to update the TOU at any time without notice to you.

The Site Does Not Provide Chiropractic, Medical Or Other Professional Advice

The contents of the Website, such as text, graphics, images, and other materials created by ACA and other materials contained on the Website (collectively, “Content”) are for informational purposes only. The Content is not intended to be a substitute for professional chiropractic or medical advice, diagnosis, or treatment. Always seek the advice of your Doctor of Chiropractic or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional chiropractic or medical advice or delay in seeking it because of something you have read on this Website.

If you think you may have a medical emergency, call your doctor or 911 immediately. The ACA does not recommend or endorse any specific tests, doctors of chiropractic, physicians, products, procedures, opinions, or other information that may be mentioned on the Website. Reliance on any information provided on the Website, ACA employees, others appearing on the Website at the invitation of the ACA, or other visitors to the Website is solely at your own risk.

Lawful Use

The Website and information provided may be used for lawful purposes only. As one of the conditions of your use of the Website, you represent, warrant, and agree you will not use (or assist others to use) the Website for any purpose or in any manner that is prohibited by the TOU or by applicable law (including but not limited to any applicable export controls). Altering the Website or its information is forbidden without written permission and approval from ACA. You may not use the Website in any manner that could damage, disable, overburden, or impair or interfere with any other party’s use and enjoyment of the Website. You may not attempt to gain unauthorized access to any accounts, computer systems or networks connected to any ACA server through hacking, password mining or any other means. Use Content Guidelines

If you use, or post User Content on, a Public Area, such as message boards, blogs, email, chat areas, news groups, forums, communities, calendars, folders and/or other message or communication options designed to enable you to communicate with others (hereinafter known as “Communications”) you agree you will be entirely responsible for all content that you upload, post, email or otherwise transmit through the Website, and understand that any online communications may not be confidential. ACA is not responsible for any information posted by a third party. You agree you will comply with all laws related to copyright and intellectual property, and will not post any materials that violate any laws, advocate illegal activity, infringe upon a third-party copyright, or invade the privacy or publicity rights of others. You further agree that you will not:

  1. Post, publish, upload, distribute or disseminate anything that is inappropriate, profane, knowingly false, defamatory, vulgar, obscene, threatening, abusive, hateful, pornographic, embarrassing or has potential to cause harm or damage to anyone.
  2. Post anything of a sexual nature and will not use the Website for junk mail, spam, chain letters or pyramid schemes; and you cannot impersonate anyone or misrepresent who you are.
  3. Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another.
  4. Advertise or offer to sell or buy any goods or services for any business purpose, unless Communications specifically allow such messages.
  5. Use the Services in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
  6. Download any file posted or produced by another user that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
  7. Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  8. Restrict or inhibit any other user from using and enjoying the Services in accordance with the TOU.
  9. Violate any applicable laws, regulations, code of conduct or other guidelines which may be applicable for particular Communications.
  10. Harvest or otherwise collect information about others, including e-mail addresses.
  11. Create a false identity for the purpose of misleading others.

Any message posted are the express view of the poster and does not reflect the views of ACA. ACA has no obligation to, and does not in its normal course, pre-screen, monitor or review the materials posted online. ACA is not responsible for and does not exert editorial control over any materials posted online, however, ACA reserves the right to pre-screen, monitor and/or review all materials posted, or to refuse to post or remove a post.

You warrant and represent that you are at least eighteen (18) years of age (21 in some jurisdictions) and have the legal capacity to use the Website. ACA makes no representation or warranty that the content published on the Web Site complies with the local laws of your jurisdiction. You are solely responsible for knowing and understanding your local laws concerning content legality.

Online Education

This additional Terms of Use Agreement sets forth the standards of use of the ACA Online Education Service for Registered Members. By using the ACA Online Education website you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at ACA Online Education website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

1. Description of Service
ACA Online Education is providing Member with online education services. Member must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Member’s access to the Internet, and (3) pay any fees relate with such connection.

2. Disclaimer of Warranties. The site is provided by ACA Online Education on an “as is” and on an “as available” basis.
To the fullest extent permitted by applicable law, ACA and ACA Online Education makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. ACA and ACA Online Education shall have no liability for any interruptions in the use of this Website. ACA and ACA Online Education disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; therefore the above-referenced exclusion is inapplicable.

Member agrees to indemnify and hold ACA and ACA Online Education, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.

5. Members Account
All Members of the Service shall receive a password and an account. Members are entirely responsible for any and all activities which occur under their account whether authorized or not authorized. Member agrees to notify ACA Online Education of any unauthorized use of Member’s account or any other breach of security known or should be known to the Member. Member’s right to use the Service is personal to the Member. Member agrees not to resell or make any commercial use of the Service without the express written consent of ACA Online Education.

6. Modifications and Interruption to Service
ACA Online Education reserves the right to modify or discontinue the Service with or without notice to the Member. ACA and ACA Online Education shall not be liable to Member or any third party should ACA Online Education exercise its right to modify or discontinue the Service. Member acknowledges and accepts that ACA Online Education does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

7. Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. 9. Governing Jurisdiction
Our website is operated and provided in the Commonwealth of Virginia. As such, we are subject to the laws of Virginia, and such laws will govern this Additional Terms of Use Agreement, without giving effect to any choice of law rules. We make no representation that our website or other services are appropriate, legal or available for use in other locations. Accordingly, if you choose to access our site you agree to do so subject to the internal laws of Virginia.

Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.

13. Botnets
ACA Online Education retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, ACA Online Education reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.

14. Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. The trademarks, logos, service marks, text and content displayed on the Website are the property of ACA or other third parties. You are not permitted to use any intellectual property without the prior written consent of ACA or such third party that may own the intellectual property. You agree not to reproduce, duplicate, copy, sell or exploit for any commercial purpose, any portion of the Web Site and the services, products, or content provided by the Website.

Any party is free to download ACA’s official logo for the sole and exclusive purpose of linking to www.acatoday.org. All other uses are strictly prohibited without prior approval.

The American Chiropractic Association (ACA) respects the privacy of its members and other visitors to its Website and has established the following policies to protect your online privacy.

Data Collection

ACA collects a variety of data for use primarily for purposes of helping the Association better serve its membership. ACA periodically reviews its privacy policies and any and all changes will be updated to the ACA Website:

General Users who Browse WWW.ACATODAY.ORG.

  • ACA does not collect any personal information from general users browsing its Website. Users to the public areas of ACA’s website may browse anonymously. ACA collects only cumulative data—number of views, open rates, click rates—to use for internal analytical and marketing purposes.

ACA Members and Registered Users

  • ACA controls access levels based on membership type. Access to content on ACA’s Website is granted based on membership type and requires a valid login and password (refer to Terms of Use for related policies). Users are asked to submit their information voluntarily. Members who wish to access member-only sites or sections may provide specific information for a variety of reasons, including, without limitation, enabling ACA to process and confirm membership eligibility, providing members with the opportunity to enhance their personal listing in ACA’s online directory and update their opt-in/out preferences. For event registrations, ACA asks users to provide information to enable ACA to process registrations to an ACA event in a timely and accurate manner, regardless of membership eligibility.
  • Similar information may be submitted to ACA through membership applications, conference or seminar registration, publication orders, subscriptions, and professional development education and training registrations. Additionally, ACA will collect certain information on email disposition sent in HTML format to its members (open and click rates on links provided in the message). Other information collected through tracking capabilities includes: date and time of the user’s click, email addresses of specific send lists, URL number and destination page. This information is not sold or distributed in any other manner.

ACA’s Use of Collected Data

ACA uses information voluntarily submitted by members and other customers in the following ways:

  • ACA Member Services and Products. Generally, ACA use data collected to improve its web content; to respond to users’ interests, needs and preferences; and to develop and deliver new products and services.
  • Disclosures to Third Parties. ACA makes member contact information available through ACA’s online directory, Find a Doctor. ACA members in good standing can update their online profile at any time. On occasion, ACA may also provide limited data to third parties that offer products and services, however, users may request that ACA refrain from disclosing the data it collects to third parties by opting out electronically in their user profile. Alternatively, users may contact ACA at 703-276-8800 to express their preferences if they determine that they do not wish to have personal information shared.
  • Consent to Use Personal Information. For the purposes of the Data Protection Act(s) of 1984 and 1998 (as applicable, ACA or its agents must store, host and otherwise process the information (including personal data) supplied by the User when registering for this Web site. Users supply consent at the time of application for membership in ACA.
  • Credit Card Account Information. ACA does not disclose or store credit card account information provided by its members, users and customers. When uses choose to pay with their credit cards, ACA submits the information needed to obtain payment to the appropriate clearinghouse for processing.

ACA’s Use of Cookies

Cookies are files that contain information created by a web server that can be stored on a user’s hard disk for use either during a particular session (“per-session” cookie) or for future use (“persistent” cookie). ACA uses cookies to facilitate automated activity, store and track passwords, determine appropriate solicitations, and review navigation patterns. Cookies are not used to disseminate significant information about users over the Internet or to analyze any information users have knowingly or unknowingly provided.
